Definition of terms

  • The term “host” refers to the retreat/workshop/class/event organiser Tamara Miller.

  • The term “event” covers in-person events such as a retreat, workshops and classes or any other events as well as online events.

  • The term “coach” refers to Tamara Miller (certified UESCA Ultra Run coach, personal trainer and nutritionist)

  • The term “client” refers to the person booking a coaching programme, retreat, workshop, class, 121 call, 121 run technique sessions or hypnotherapy sessions.

  • The terms “classes” and “session” refer to in-person as well as online classes including hypnotherapy / guided visualization recordings.

Booking

(a) Your booking is not considered definite and no contract will exist until we receive the full amount. By booking a retreat with the host, you are accepting these terms and conditions.

(b) The host does not share customer details with any third parties.

(c) The payment is non-refundable if you drop out of the retreat for any reason, and at any time.

Payment

(a) The price is the exact amount to be received in full in GBP.

(b) The full payment amount is due 30 days or more before the retreat day and can be paid by bank transfer to the account specified in your original confirmation email sent out after your booking is confirmed or your deposit has been received. If full payment is not made 30 days or more prior to the date of the retreat, it will be assumed that you wish to cancel your booking.

Your Travel Arrangements

All travel arrangements are your responsibility and at your own cost. The host shall not be held liable for any consequences arising from delays or cancellations in any of the companies you may have made arrangements with, or for any irregularities in your documentation required for travel. Transfers to/from the retreat are at your own cost, unless otherwise specified.

Your Health

(a) It is your responsibility for ensuring your own fitness to participate in the retreat and will declare all medical details if required. The host reserves the right to cancel a booking if the participant fails to show the ok from their GP if required. It is also your responsibility to let the host know when anything has changed about your health status since you filled in the health check form.

(b)It is your responsibility to let your host know if you have any injuries and to be mindful at all times of your own body’s capabilities during the event. If you experience any injury or discomfort during any activity during the event, then you must desist immediately.

(c) It is also your responsibility to consult a doctor with an understanding of yoga, (trail) running and sauna to check that you are sufficiently fit and healthy to undertake such classes and other physical activities that you may chose to do whilst on the event.

(d) Please advise us of any mental or physical health conditions and allergies before you book. If you have health conditions and dietary requirements that may be affected by the activities offered on the retreat, the host reserves the right to advise you to desist and in the interests of your health, or others, we may decline your stay at the event.

(e) Whilst all measures are taken to ensure a high standard of health and safety, we are situated in the countryside where the land is uneven and we shall not be responsible for any injuries caused by uneven terrain.

(f) The host shall not be held responsible for any injuries sustained during the sauna, cold plunge, sea dips, sitting around an open fire place or other event activities.

(g) Please inform the host of any known allergies or dietary requirements at the time of booking.

Cancellation by you

(a) In the event that you become unable to attend, you need to inform the host as soon as possible via email at tam@mindfuelbody.com

(b) The host accepts no liability for any damage, injury or loss suffered by or to you, or to any other persons, or to any property in connection with the retreat or otherwise.

(c) While the host will take every care with the staging of the event, the participant acknowledges that personal accident and personal items insurance is their sole responsibility.

Photography & Videography

The participant consents to being photographed and filmed throughout the event and that these films and photographs may be used in any media for the purpose of advertising, publicity and otherwise in relation to the exploitation of the event (and future events) and/or the promotion. If you do not wish to appear on photographs and videos, please raise that with the host before the retreat starts and you won’t be part of the media.

Amendments by the host

Occasionally, changes may have to be made (e.g. yoga teacher, class times or open fire place due to weather, other arrangements), which the host reserves the right to do at any time. If a significant change becomes necessary, the host will inform you as soon as possible before your departure.

Cancellation by the host

The host reserves the right in any circumstances to cancel the event. In this case, a refund of the total amount will be paid to you.

The host’s liability to you

(a) The host accepts responsibility for ensuring that the event is supplied as described and that the services they are contractually obliged to provide are to a reasonable standard.

(b) The host does not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond their control.

(c) The host is not liable for any injuries you may incur. Yoga classes, walks, (trail) runs, sauna, plunge, sea dips and other activities are undertaken at your own risk. The host is not liable for any allergies or illnesses caused by the provided foods and drinks. The host is not liable for any issues caused by a guided meditation, visualization or hypnotherapy practice. The host is not liable for any medical or psychiatric conditions, which may develop during or subsequent to the event. The host is not liable for loss of, or damage to, your personal property.

(d) The host reserves the right at any time to remove participants from the event or prevent participants participating in the retreat if in the event the host’s sole discretion, they consider such action necessary for safety reasons or the proper enjoyment of the retreat by other participants or for any other reasonable reason. No refund shall be made if the participant has acted negligently, maliciously, with wilful misconduct or otherwise without due care and attention for the event or other participants, so as to cause their removal.

No Liability for possessions

The host cannot be held responsible for any loss or damage to personal belongings during an event.

Alcohol

Alcohol is not permitted on-site at the event. The events are aimed at providing and facilitating activities in line with health and wellness, and therefore consumption of alcohol on-site at the retreat is not permitted.

ASSUMPTION  OF   RISK, WAIVER   AND   RELEASE   OF LIABILITY, AND   INDEMNITY AGREEMENT

Declarations

This agreement is entered into between the coach and the client. The provision of coaching services by coach to client, and client’s use of any premises, facilities or equipment are contingent upon this agreement.

This agreement also covers the Social Trail Tribe hikes which are free of charge and do not represent a coaching service.

Assumption of risk

You agree that if you engage in any physical exercise or activity, you do so at your own risk and assume the risk of any and all injury and/or damage you may suffer, whether while engaging in physical exercise or not. This includes injury or damage sustained while and/or resulting from using any premises or facility, or using any equipment, whether provided to you by Coach or otherwise, including injuries or damages arising out of the negligence of coach, whether active or passive, or any of coach’s affiliates, employees, agents, representatives, successors, and assigns. These include any online challenges you might participate in via social media or the membership portal.

Your assumption of risk includes, but is not limited to, your use of any exercise equipment (mechanical or otherwise), sports fields, roads/trails (public or private), courts, or other areas, locker rooms, sidewalks, open bodies of water, swimming pools, swim flumes, parking lots, stairs, whirlpools, saunas, steam rooms, or other general areas of any facilities, or any equipment. You assume the risk of your participation in any activity, class, program, instruction, or event, including but not limited to weightlifting, walking, running (indoor or outdoor), cycling (indoor or outdoor), swimming (indoor or outdoor) or cross training activities. You agree that you are voluntarily participating in the aforementioned activities and assume all risk of injury, illness, damage, or loss to you or your property that might result, including, without limitation, any loss or theft of any personal property, whether arising out of the negligence of Coach or otherwise.

Release

You agree on behalf of yourself (and all your personal representatives, heirs, executors, administrators, agents, and assigns) to release and discharge coach (and coach’s affiliates, related entities, employees, agents, representatives, successors, and assigns) from any and all claims or causes of action (known or unknown) arising out of the negligence of coach, whether active or passive, or any of coach’s affiliates, employees, agents, representatives, successors, and assigns.

This waiver and release of liability includes, without limitation, injuries which may occur as a result of (a) your use of any exercise equipment or facilities which may malfunction or break, (b) improper maintenance of any exercise equipment, premises or facilities, (c) negligent instruction or supervision, including coaching, (d) traveling to or from coaching session(s).

Indemnification

By execution of this agreement, you hereby agree to indemnify and hold harmless coach from any loss, liability, damage, or cost coach may incur due to the provision of coaching by coach to you.

Acknowledgements

You expressly agree that the foregoing release, waiver, assumption of risk and indemnity agreement is intended to be as broad and inclusive as permitted by the law in the United Kingdom and that if any portion thereof is held invalid, it is agreed that the balance of the waiver will continue in full legal force and effect. You acknowledge that Coach offers a service to his/her clients encompassing the entire recreational, sporting and/or fitness spectrum. This release is not intended as an attempted release of claims of gross negligence or intentional acts.

You acknowledge that you have carefully read this waiver and release and fully understand that it is a release of liability, express assumption of risk and indemnity agreement. You are aware and agree that by executing this waiver and release, you are giving up your right to bring a legal action or assert a claim against coach for coach’s negligence, or for any defective product used while receiving coaching services from coach. You have read and voluntarily signed the waiver and release and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.

The host/coach reserves the right to change the terms and conditions when necessary due to the continual evolving nature of the business. It is your responsibility to ensure that you are up to date with the latest terms and conditions.
